Welcome to UNTREADS. These Terms of Service ("Terms") govern your use of our website at untreads.com and any purchase you make from us. By placing an order, you agree to these Terms. Please read them carefully.
Nothing in these Terms limits or excludes any rights you have under mandatory consumer protection laws of the country in which you live. Where these Terms conflict with such laws, the law prevails.
1. About Us
UNTREADS is an online footwear store.
All transactions are processed in EUR.
2. Eligibility
By using our website, you confirm that you are at least 18 years of age or have the consent of a parent or guardian. You agree to provide accurate and complete information when placing an order, including a valid phone number, which our delivery partners require in order to complete delivery.
3. Products
All products sold on our website are new. We make every effort to display product images and descriptions as accurately as possible; however, colours may vary slightly depending on your screen settings. Minor variations that do not affect the nature, function, or quality of the product do not constitute a defect. We reserve the right to limit quantities or discontinue products at any time.
Products are stored, packed, and shipped on our behalf by our fulfilment partners. This does not affect your rights: your contract of sale is with us, and we remain fully responsible to you for your order.
4. Pricing and Payment
All prices are displayed in EUR and include applicable VAT unless stated otherwise. Shipping costs, where applicable, are shown separately at checkout before you confirm your order.
We accept the payment methods available at checkout. We do not support cash on delivery.
In the event of an obvious pricing error, we may cancel the affected order before dispatch and will refund any amount you have paid in full. We will inform you of the cancellation and, where possible, offer you the opportunity to purchase the product at the correct price.
5. Orders and Acceptance
Placing an order constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation email and payment has been successfully processed. We reserve the right to decline an order for legitimate reasons (for example, suspected fraud, product unavailability, or delivery restrictions); in such cases, any payment made will be refunded in full without undue delay.
6. Shipping and Delivery
Delivery regions: We currently ship to the European Union, and the United Kingdom. Available delivery destinations are shown at checkout.
Delivery method: Orders are delivered either door-to-door or to a pickup point, depending on your location:
- Door-to-door delivery: Belgium, Germany, Ireland, Luxembourg, the Netherlands, Slovenia, the United States, and the United Kingdom.
- Pickup points: All other supported countries. If an item is too large or there is no pickup point within 5 km of your address, the order will be delivered door-to-door instead.
Carriers: Most orders are delivered by DPD. Some orders may be shipped via DHL, FedEx, USPS, UPS, Omniva, or PostNord.
Dispatch and delivery times: Orders are normally dispatched on the next business day after they are placed, except for certain made-to-order products. Most orders within the EU arrive within 3–8 business days; deliveries to the UK and US may take longer. Delivery times shown are estimates. In any case, we will deliver your order no later than 30 days after the conclusion of the contract, unless a different time has been agreed with you. If we fail to deliver within this period, you may set an additional reasonable deadline and, if we still fail to deliver, cancel the order for a full refund.
Tracking: Tracking information is provided for all orders shipped within the EU and for some US and UK orders. You will find tracking details in your shipping confirmation email.
Multiple brands: If your order contains products from different brands, they may be dispatched as separate shipments and may arrive at different times. Any applicable shipping charges are shown at checkout before you place your order.
Risk and title: If you are a consumer, the risk of loss or damage to the products passes to you only when you (or a third party indicated by you, other than the carrier) take physical possession of the goods. Title passes to you upon delivery, provided payment has been received in full.
7. Right of Withdrawal (EU and UK Consumers)
If you are a consumer in the EU or UK, you have the right to withdraw from your purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which you (or a third party indicated by you, other than the carrier) receive the goods. If your order was delivered in multiple shipments, the period expires 14 days after receipt of the last item.
How to withdraw: Inform us of your decision by an unequivocal statement (for example, an email to info@untreads.com) before the withdrawal period expires. You may use the model withdrawal form below, but it is not obligatory:
Model withdrawal form: "I hereby give notice that I withdraw from my contract of sale of the following goods: [product], ordered on [date] / received on [date]. Name of consumer, address of consumer, date."
Returning the goods: You must send the goods back without undue delay and in any event no later than 14 days from the day you informed us of your withdrawal. We will provide the return address when you contact us. You bear the direct cost of returning the goods, unless the item is faulty or we sent you the wrong item.
Refund: We will refund all payments received from you, including standard delivery costs (but not any supplementary costs arising if you chose a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the day we are informed of your withdrawal. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them back, whichever occurs first. Refunds are made using the same payment method you used, unless you expressly agree otherwise; you will not incur any fees for the refund.
Condition of returned goods: You may inspect the goods to establish their nature, characteristics, and functioning as you would in a physical shop (for footwear, this means trying shoes on indoors on a clean surface). You are liable for any diminished value of the goods resulting from handling beyond this, and we may deduct a corresponding amount from your refund. We ask that you return items unworn, with all original labels and, where possible, in the original packaging.
Exceptions: The right of withdrawal does not apply to goods made to your specifications or clearly personalized, or to sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
8. Legal Guarantee and Warranty
If you are a consumer in the EU, you benefit from a legal guarantee of conformity of at least two years from delivery. If a product is defective, not as described, or otherwise does not conform to the contract, you are entitled to have it repaired or replaced free of charge or, where that is not possible or is not carried out within a reasonable time, to a price reduction or a full refund. UK consumers benefit from equivalent statutory rights under the Consumer Rights Act 2015.
In addition, the products we sell carry a 2-year manufacturer warranty against manufacturing defects.
How to make a claim: Contact us at info@untreads.com with your order number, order date, the product concerned, a clear description of the issue, and photos if possible. If we ask you to return an item for inspection, please ensure it is clean; we may be unable to inspect items returned in an unhygienic condition. We will cover the cost of return shipping for valid claims.
Claims under the legal guarantee or warranty are separate from, and do not affect, your 14-day right of withdrawal described above.
9. Faulty or Incorrect Items
If you receive a damaged, faulty, or incorrect item, contact us at info@untreads.com as soon as possible with your order number and photos of the issue. We will arrange a replacement, repair, or full refund (including delivery and return shipping costs) at no cost to you.
10. Intellectual Property
All content on this website, including text, images, logos, and graphics, is the property of UNTREADS, its content suppliers, or the respective brand owners, and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission from the rights holder.
11. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
Subject to the above, we shall not be liable for any indirect or consequential losses that were not foreseeable to both parties when the contract was formed, and our total liability in connection with any order shall not exceed the total amount paid for that order.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Lithuania. If you are a consumer residing in another country, you also benefit from the mandatory consumer protection provisions of the law of your country of residence, and nothing in these Terms deprives you of that protection. As a consumer, you may bring proceedings in the courts of your country of residence or in the courts of Lithuania.
Out-of-court dispute resolution: If you are a consumer and we are unable to resolve a complaint, you may submit a request to the State Consumer Rights Protection Authority of the Republic of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba), Vilniaus g. 25, 01402 Vilnius, Lithuania, www.vvtat.lt, or to its territorial units.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. The version of the Terms in force at the time you place your order applies to that order.
